Under state law, shoplifting is defined as a theft of goods from an open retail establishment and falls under the category of larceny. Depending on the amount alleged to have been stolen, individuals may face charges for petty theft or grand theft. Penalties can increase if the offender has a history of shoplifting convictions.
Penalties for Shoplifting in California
All too often, individuals wrongly assume that shoplifting will result in a simple slap on the wrist. The truth is, shoplifting can carry serious penalties, including hefty fines and even years in jail. Penalties for shoplifting include:
- Petty theft ($50 or less). If the offender has no previous convictions, the crime may be classified as an infraction and carry a $250 fine.
- Petty theft ($950 or less). Considered a misdemeanor charge, individuals can face a fine of $50 to $1,000 and six months in jail.
- Grand theft ($950 or more). Depending on the nature of the crime, this offense may be a misdemeanor or felony and include one year of jail time. Individuals caught stealing a firearm can also face a grand theft conviction with jail times lasting 16 months, two years, or three years.
